ES' ART COMMISSION TERMS OF SERVICE

By ordering a digital commission from me @nnces, you accept and agree to be bound by the terms and conditions listed below. I reserve the right to take legal action against any user who violates these terms, including but not limited to revoking the user's right of commercial and pursuing legal remedies.

I. User Agreements.

1. MY PART.1.1. I work on a first come, first served basis upon my public Queue.1.2. This is a win-win, I completely can decline commission even when we're in the final stages if:
a) Customers have bad behaviour/ attitudes.
b) Requested thing that makes me allergic/ uncomfortable to work with.
c) You're on my blacklist/ You're someone I've zoned out to unwilling to work with.1.3. If you take my artworks anywhere, you must link back to me at https://nnces.carrd.co in the credit section.2. YOUR PART.2.1. You have the rights to the artworks I've made for you except:
a) Your rejected sketches as further references.
b) By default, there's no commercial rights.
c) Strictly no AI-training using my art.2.2. Your rights are not include commercial printing or claim as you are the author unless agreed upon/ negotiation.

II. Payments.

1. METHODS.1.1. I will not start the commission work for any case of wrong money transfer/problem that I haven't received on my ends.1.2. All payments are in USD ($) via the given DM'ed method.
a) This must be sent after I accept your requirement of commissioning.
b) You could pay 60% or All before I started drawing.1.3. The maximum time to fully finish payment is two weeks from the time my Queue starts. Past this time:
a) Your name will be moved to the bottom of the list.
b) Your order will be cancel if uniformed.1.4. After the sketches are approved, I'm on my way to complete the painting only after the final payment is made.2. REFUNDS.2.1. I can always refund your amount at any steps (if you so wish or I'm in my disadvantage situations).2.2. Refunds will be calculated fairly based on the progression of the artwork.

III. Contents.

1. WILL DRAW.1.1. Characters: Your original characters, your favorite 2D characters, characters from Anime/ Manga/ Vtuber, pictures of real people, etc. are accepted.1.2. Background if included: Simple BG/ Vector. Casual life. Furnitures & Furnishing. Aesthetic mood: Coffee shop/ Under water/ Galaxy/ etc.2. WILL NOT DRAW.2.1. I refuse to work on commissions that the characters are:
a) A stolen one.
b) You don't have the right to order art to.
c) NSFW content. Bara.
d) Gore or horror traits (light gore is fine, need more discuss).2.2. Background if included: Super detailed BG. (Or maybe I can when you pay more for it, but better not to order because I'm not sure I'll have time).

IV. The Progress.

1. SKETCHWORK.1.1. I am not responsible for what you have not described or said clearly.1.2. 01 - 03 first sketches are free. From the fourth time I'll add a $2 fee over any edits.1.3. Please be clear and concise in your description of the changes maybe consider to use photos as reference.2. LINE-ART & BASED COLORS.2.1. I will always distribute a "color test" to fix any color errors.2.2. Anything that needs to be edited on my behalf, as it was on your references and I missed it, will always be edited for free.2.3. After this step you are not allowed to change anything about the line-art.3. UP TO FINISH.3.1. When finished, I will give you all these following variations:
a) A full size .png, transparent background, no watermarks image (that shouldn't be uploaded).
b) A full size .png, with background if included, watermarked image.
c) A resize .jpeg, with background if included, watermarked image (that is ready to post).3.2. No original drawing files with separate layers attached.3.3. I will respect your wish to not publicly the commission if that's what we both do.

ES' ADOPTABLE DESIGN TERMS OF SERVICE

By purchasing/ receiving a digital adoptable from me @nnces, you accept and agree to be bound by the terms and conditions listed below. I reserve the right to take legal action against any user who violates these terms, including but not limited to revoking the user's right to use the adoptable and pursuing legal remedies.

I. Copyrights.

1. CREDITS.1.1. I retain authorship credits to both the design and the original artwork.1.2. You may not edit the original artwork without confirming me first.
a) Even when the edition was done, the credit given to me couldn't be removed beside additional design credits to the appropriate user(s).
b) You may not trace over the original artwork, post the traced artwork and act as author over it.2. REDISTRIBUTION.2.1. This rule applies level-to-level basis each time the adoptable is rehomed:
a) Gifted/ free adopts can only be regift.
b) Traded adopts can be retrade or regift.
c) Sold adopts can be resell, retrade or regift.2.2. Additional commission work for any of the adopts may be counted. However, evidence of purchase is required.2.3. Unless there are commission artworks added, discussed and agreed upon by @nnces the original creator, the adoptable cannot be redistributed for more than the original values.

II. Monetary Involves.

1. PURCHASING.1.1. All payments are in USD ($) via the given DM'ed method.
a) Payment is expected full upfront.
b) Payment plans might be accepted with proper discussion. The adoptable will be transferred to the client only after the final payment is made.
c) Holds are not accepted under any circumstances.1.2. Transaction fees do not count to the adoptable's purchase price.1.3. If payment isn't received within 36 hours after I respond to the purchase claim, the current discussion will be canceled and the adoptable will be put up for sale again.1.4. No refunds at any stages and any steps.2. COMMERCIAL USAGE.2.1. Commercial use of the adoptable requires explicit written permission from @nnces and may involve additional fees or royalties.2.2. Commercial use includes, but is not limited to:
a) Digital products: Selling digital products featuring the adoptable (e.g., digital art, avatars, NFTs).
b) Commercial projects such as video games, animations, or webcomics.
c) Merchandise: Selling physical goods featuring the adoptable (e.g., prints, stickers, plush toys).2.3. You may not gift/trade/resell commercial authorization to a new user. As well as you may not raise the resell price of the character itself after purchasing commercial use authorization.

III. Prohibited Actions.

1. CONTENTS.1.1. You may not use the adoptable adopted from me to create or publish prohibited content, this includes but is not limited to:
a) Illegal and Harmful Content: You agree not to use the adoptable to create or distribute any content that is illegal, harmful, abusive, threatening, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically or otherwise objectionable.
b) Exploitative Content: You specifically agree not to use the adoptable to create or distribute any content that exploits, abuses, or endangers children, such as child pornography or child exploitation.
c) Infringing Content: You agree not to use the adoptable to create or distribute content that infringes on the intellectual property rights of others.2. LIABILITY.2.1. User Responsibility: You are solely responsible for any content you create or distribute using the adoptable.
2.2. Indemnification: You agree to indemnify and hold harmless @nnces from any claims, damages, liabilities, costs, and expenses, including reasonable attorneys' fees, arising from your use of the adoptable or violation of these terms of service.

Please help me reporting if you see any transactions that against any of my rules stated above.
